- Hitler Is Very Upset That Constantin Film Is Taking Down Hitler Parodies [TechCrunch] – It looks like the Hitler Gets Upset About [Whatever] meme might be drawing to an end thanks to copyright issues. Constantin Film, the production company behind Downfall (Der Untergang in German) have asserted their copyright over the Downfall footage and YouTube’s automated system appears to be pulling the clips down all over their service. I’d like to think everyone will be filing counter-claims since this is clearly Fair Use according to US copyright law (how could this not be parody or satire?) but we’ll have to see what happens. (An Open Video Alliance post notes that the”videos were blocked by YouTube’s Content ID system, not taken down via DMCA notices”). Meanwhile, until it disappears, here’s Hitler’s thoughts on the Downfall videos disappearing.
- Facebook Further Reduces Your Control Over Personal Information [Electronic Frontier Foundation] – EFA on Facebook’s advertiser-orientated, privacy-diminishing strategies: “Today, Facebook removed its users’ ability to control who can see their own interests and personal information. Certain parts of users’ profiles, “including your current city, hometown, education and work, and likes and interests” will now be transformed into “connections,” meaning that they will be shared publicly. If you don’t want these parts of your profile to be made public, your only option is to delete them. […] The new connections features benefit Facebook and its business partners, with little benefit to you. But what are you going to do about it? Facebook has consistently ignored demands from its users to create an easy “exit plan” for migrating their personal data to another social networking website, even as it has continued — one small privacy policy update after another — to reduce its users’ control over their information. The answer: Let Facebook hear your frustration.”
- More Changes to Facebook Privacy, and More to Come [Social Hacking] – “… Facebook is changing the “Become a Fan” buttons to “Like” buttons. If you want to connect with a page for something you’re interested in, you now will simply “like” the page. In a blog post, Facebook spun the connections as an exciting improvement: “Instead of just boring text, these connections are actually Pages, so your profile will become immediately more connected to the places, things and experiences that matter to you.” I can see three main reasons why Facebook would make this change, and none of them involve text being boring. […] First, this helps software more easily process your interests. […] Second, the shift to “liking” reduces friction. The semantics may be subtle, but I’m sure Facebook has done research on this. “Liking” implies a simple, casual gesture […] Third, this increases the useful data Facebook can offer to others.”

- YouTube mum wins mammoth music battle [ABC News (Australian Broadcasting Corporation)] – A win for US fair use: “A woman in California has won a partial victory in a lawsuit against a record company that forced her to remove a video she posted on YouTube. The woman posted a video of her young child dancing to the Prince song Let’s Go Crazy. Universal Music, which owns the copyright, demanded YouTube remove the video – which it did. With help from a group of free speech activists, she filed a suit saying her video constituted a fair use of the song. A California judge has ruled in her favour, saying she is entitled to at least recover her legal fees. Observers say this is an important case in copyright-infringement law.”
- This week in search 2/28/10 (Google Adds Facebook Status Updates to Search) [Official Google Blog] – Google officially adds Facebook status updates to their real-time search function (with the implicit flow-on into ‘normal’ Google search, as with Twitter): “Facebook in real-time search: Starting this week we added Facebook content to real-time search in the U.S. Real-time search, which we launched in December, helps you tap into the most relevant, freshest search results on the web, many of which are just seconds old. With this latest addition, you can access the news, photos and blog posts that Facebook fan pages publish to the world. - Academic Author Sues Journal Editor For Criminal Defamation Over Negative Book Review [Techdirt] – After a book review she was unhappy with wasn’t removed from publication at her request, Karin Calvo-Goller is suing the journal editor for criminal defamation (in the French courts). Apart from fundamentally misunderstanding how the culture of academic book reviewing works, I fear Calvo-Goller is rather unfamiliar with the Striesand Effect!
- How to Deal With Twitter DM Spam [Mike Haydon] – “There is a lot of malware spam on twitter at the moment. I’m getting between 100-500 Direct Messages (DMs) a day from compromised accounts. They say things like: “i made $426.23 online today with” “I make money online with google. i learned how here” “this you here” “hey can you do me a favor? take this iq test. here” “hey. can you take this quiz thingy? here” “rofl this you???” “LOL, omg this you?” “hahah you should see this” “You’re on here…” […] … all with links at the end. I just copy/pasted some of the ones I received today. DON’T CLICK THE LINK even if it’s from one of your friends. It seems the link takes you to a site where your twitter account gets hacked and sends the same sort of DMs to your followers.”

- Murdoch may block Google searches [BBC NEWS | Business] – Murdoch plans to pull News Corps stories from Google. And apparently he thinks he can do away with fair dealing, too. I fear the old tiger is roaring his last roars: “Rupert Murdoch has said he will try to block Google from using news content from his companies. The billionaire told Sky News Australia he will explore ways to remove stories from Google’s search indexes, including Google News. Mr Murdoch’s News Corp had previously said it would start charging online customers across all its websites. He believes that search engines cannot legally use headlines and paragraphs of news stories as search results. “There’s a doctrine called ‘fair use’, which we believe to be challenged in the courts and would bar it altogether,” Mr Murdoch told the TV channel. “But we’ll take that slowly.””
- Journalists are the audience formerly known as the media [bronwen clune] – Bronwen Clune’s Media 140 talk in which she makes some very sensible noises about journalists on Twitter: “Participatory media doesn’t mean you letting your audience participate in the creation of news, it about acknowledging that you participate in news creation along with your audience. … We’ve heard Jay Rosen’s quote here a few times today about “the people formerly known as the audience.” To which I’d like to add: Journalists are the audience formerly known as the media.”
- Iran, Twitter and the new media world. [Off Air] – Mark Colvin’s thoughtful and detailed look at the Twitter Revolution in Iran, looking at the ethics and practice of getting information via Twitter, some sensible methods for gauging accuracy of tweets, the danger in distorting figures on both sides, and the fact that, at the end of the day, Iran’s Twitter Revolution failed … but there were seeds of hope: “The first victory is that for millions of people around the world, Iranians were not faceless Middle Easterners …You cannot bomb a regime without bombing its people … The second victory is that they saw themselves as we saw them, and they saw us cheering them on. They saw ordinary people in countries like America – which the ayatollahs call The Great Satan – and Britain – The Little Satan – coming out in support of their hopes and fears. For once that couldn’t be censored by State media.”

- Vigilantes publish alleged arsonist’s image online [The Age] – “Facebook vigilantes, frustrated at a court order protecting a man charged with lighting one of the deadly Victorian bushfires, which killed at least 11 people, have published his photograph and address on the social networking site and threatened his life. The move potentially breaches an order suppressing his image and address amid fears of a violent backlash by angry victims. Victoria Police has contacted Facebook seeking the removal of the details and urged people to let police do their job. This morning the suppression order on naming the man, Brendan Sokaluk, 39, was lifted, but the order remains in place on publishing his street address or his image. At least two Facebook groups have been created to name and shame the alleged arsonist, and thousands of Facebook users have joined them. Membership is growing rapidly as word spreads.” (While I completely understand people’s anger, this sort of social networking lynch mob mentality is really quite dangerous.)
- Fair Use Held Hostage by ABC-Disney [Just TV] – Jason Mittell’s tale of how aquiring copyright permission from ABC/Disney for a cover image for his new book, Television and American Cuture, became a debacle with Disney refusing to license the cover image unless the publishers licensed every internal Disney image – something that should be covered by fair use – but with the book already at the printers, the publishers gave into Disney’s demands. As Mittell notes, Disney are legally able to do this, but it’s a bit of a slap in the face for fair and educational uses.
- Murdoch looks for new ways to monetise MySpace traffic [The Age] – “”Rupert Murodch has delivered a sobering assessment about the internet as a growth engine, revealing search and advertising revenues at News Corp’s Fox Interactive Media division – which houses the popular MySpace networking site – have stalled. The new-media unit, which has invested heavily to expand MySpace, contributed just $US7 million ($10.4 million) to News Corp’s $US818 million second-quarter operating income, the company said on Friday. There was a “slight downturn” in revenue at the social networking site, Mr Murdoch said. That compares to $US179 million News Corp made from newspapers including The Wall Street Journal and information services such as the Dow Jones news wire. Asked about his views on the long-term viability of the internet, Mr Murdoch said generating a return on investment for assets such as MySpace, which News Corp bought for $US580 million in 2005, was still a challenge. “I think we have to find new ways to monetise our huge audiences,” he told analysts.”

- EFA concerned about movie industry lawsuit against iiNet [Electronic Frontiers Australia (EFA)] – “Electronic Frontiers Australa (EFA) today expressed concern about a lawsuit filed against Internet Service Provider iiNet in the Federal Court. A consortium of media companies have sued the ISP for allegedly allowing its users to download infringing movies and TV shows by failing to terminate their accounts after allegations of infringement by the copyright industry. “This lawsuit is the latest attempt by the movie industry to bully Internet Service Providers into becoming copyright police,” said EFA spokesperson Nicolas Suzor. “ISPs are not in a position to monitor and terminate internet access to users based upon unsubstantiated threats from copyright owners, and should not be asked to do so.””
- Kraftwerk sample case overturned [BBC NEWS | Entertainment] – “A court in Germany has told electronic band Kraftwerk that a producer who sampled one of their songs was not violating copyright. The ruling overturns an earlier decision against Moses Pelham’s use of a short sample from Metal on Metal. Judges in Berlin said the two second extract did not infringe copyright, as his song was substantially different. The move will come as a blow to artists who object to rivals using samples of their work to create new songs. ” (Bring on the legal remixes and mashups!)
- Immersion [The New York Times – Video Library] – A fascinating video by Robbie Cooper which captures the faces of young people as they play videogames – watch that concentration! (There are photos, too.)
- ‘The Dark Knight’ Conquers BitTorrent [TorrentFreak] – This week, in another round of leaks, DVD-rips of ‘The Dark Knight’ found their way to BitTorrent. Unsurprisingly, given the commercial success of the movie, <em>these were downloaded well over a million times in just a few days</em>. From the looks of it, Batman will crush Iron Man, The Incredible Hulk and Transformers, as it will easily become this year’s most pirated movie.
- Star Trek [Apple – Trailers] – Young James T Kirk … the beginnings of the Enterprise … angry Spock … and sex in outer space. The Star Trek reboot will either be amazing or utterly wrong!
- 19-Year-Old Lifecaster Commits Suicide on Justin.TV [smcb] – “In a tragic story from NewTeeVee, we learn that a 19-year-old user of the online live-streaming video service Justin.TV has apparently commit suicide in front of an audience of fellow forum dwellers egging him on during the process. The death has been confirmed with the Broward County medical examiner and the timeline has been pieced together from several different forums that have chronicled the unfortunate series of events.”
