  • Digital guru Clay Shirky’s media forecast and predictions for 2009 [Media | The Guardian] – “The question is who figures out the business model that says it’s better to have 6 million passionate fans than 7 million bored ones? That is going to be the transformation because what you see with these user groups, whether it’s for reality TV or science fiction, is that people love the conversation around the shows. The renaissance of quality television is an indicator of what an increased number of distribution channels can do. It is no accident that this started with cable. And the BBC iPlayer? That’s a debacle. The digital rights management thing …let’s just pretend that it was a dream like on Dallas and start from scratch. The iPlayer is a back-to-the-future business model. It’s a total subversion of Reithian values in favour of trying to create what had been an accidental monopoly as a kind of robust business model. The idea that the old geographical segmenting of terrestrial broadcasts is recreatable is a fantasy and a waste of time.”
  • NIN’s CC-Licensed Best-Selling MP3 Album [Creative Commons] – ” … Ghosts I-IV is ranked the best selling MP3 album of 2008 on Amazon’s MP3 store.Take a moment and think about that.

    NIN fans could have gone to any file sharing network to download the entire CC-BY-NC-SA album legally. Many did, and thousands will continue to do so. So why would fans bother buying files that were identical to the ones on the file sharing networks? One explanation is the convenience and ease of use of NIN and Amazon’s MP3 stores. But another is that fans understood that purchasing MP3s would directly support the music and career of a musician they liked. The next time someone tries to convince you that releasing music under CC will cannibalize digital sales, remember that Ghosts I-IV broke that rule, and point them here.”

  • Twitter accounts of Obama, Britney Spears hacked [ABC News (Australian Broadcasting Corporation)] – “The Twitter accounts of US president-elect Barack Obama, singer Britney Spears and other prominent figures were hacked on Monday (US time) and fake messages sent out in their names on the micro-blogging service. Twitter founder Biz Stone, in a post on the official company blog, said a total of 33 Twitter accounts had been hacked including those of president-elect Obama and Rick Sanchez, a CNN television anchor with tens of thousands of followers. “We immediately locked down the accounts and investigated the issue,” Mr Stone said. … Twitter, which allows users to post real-time updates of 140 characters or less, has an estimated 4-5 million users according to a recent study. Launched in August 2006, it has been embraced by a number of celebrities including president-elect Obama, who has more than 150,000 followers, and four-time NBA champion Shaquille O’Neal of the Phoenix Suns.”
  • How Windschuttle swallowed a hoax to publish a fake story in Quadrant (Margaret Simmons, 6 Jan 09) [Crikey] – “Keith Windschuttle, the editor of the conservative magazine Quadrant, has been taken in by a hoax intended to show that he will print outrageous propositions. This month’s edition of Quadrant contains a hoax article purporting to be by “Sharon Gould”, a Brisbane based New York biotechnologist.   • Facebook under fire for racist rants [The Age] – “Facebook has come under fire from Australian users for ignoring racial vilification on the site and failing to remove blatantly racist groups even though they have been flagged as offensive. Sydney-based Facebook user Alex Gollan, who has campaigned against the racist groups, has been threatened with violence and fears the site could be used to rally people if another incident such as the Cronulla riots flares up. The site permanently banned one offender this week but only after the issue of racism on Facebook came under the spotlight following revelations that Scots College and Kambala students had created anti-Semitic groups on the site.”

  • Video games and music | Playing along [The Economist] – “As the music industry searches for a new model in the age of digital distribution and internet piracy, it is getting a helping hand from an unexpected quarter: video games such as “Guitar Hero” and “Rock Band”, which let people play along to songs on simplified imitation instruments. “These games are revitalising the industry,” says Aram Sinnreich, an industry expert at New York University. “They’re helping as both a revenue and an advertising platform. … Established artists are also using the games to promote their music. Bobby Kotick, Activision’s boss, says Aerosmith have made more money from “Guitar Hero: Aerosmith”, a version of the video-game that features the band, than from any of their albums.” [Via Terry Flew]
  • Mainstream News Outlets Start Linking to Other Sites [NYTimes.com] – ” “Thou shalt not link to outside sites” — a long-held commandment of many newsrooms — is eroding. Embracing the hyperlink ethos of the Web to a degree not seen before, news organizations are becoming more comfortable linking to competitors — acting in effect like aggregators.”
  • AC/DC Electrify BitTorrent Album Downloads [TorrentFreak] – “AC/DC will release its new album ‘Black Ice’ worldwide on October 20th, in physical format only since the band doesn’t sell its music online. However, the upcoming album has already been digitized by pirates, as it leaked to BitTorrent five days ago. In that time it has taken the trackers by storm, racking up a staggering 400,000 downloads.”

  • Girl Turk: Mechanical Turk Meets Girl Talk’s “Feed the Animals” [Waxy.org] – Andy Baio’s extremely deep analysis of the use of samples in the latest Girl Talk album. While stats like “the album averages 19.8 songs sampled per track” should be really boring, the overall analysis is, for some reason, quite fascinating!

  • All Star Batman And Robin The Boy Wonder: Frank Miller Gives Batgirl Too Dirty A Mouth For DC Comics [io9] – “Earlier this week, comic retailers were notified that all copies of All Star Batman And Robin that they receive in this week’s shipments were to be destroyed instead of placed on sale. No futher explanation was forthcoming – until someone got a hold of a copy, and discovered that a problem with self-censorship had accidentally created a comic too dirty to be sold.” (Really, if you give Frank Miller a DC stock title to work with, what did you expect him to do?)
  • Facebook imposes site facelift [BBC NEWS | Technology] – “Facebook’s facelift will become permanent for all its 100 million users, like it or not. Since unveiling the makeover seven weeks ago, Facebook had given users the freedom to stay with the old design or switch to the new one. Now everyone will be forced to change despite groups forming on Facebook to protest the move. “It’s pretty lame they couldn’t let us keep the old design alongside the new one,” said student Scott Sanders. His protest page called Petition Against the “New Facebook” is the most popular group with nearly a million supporters criticising the move from the old format.” (I beleive this is called ‘pulling a Vista’!)

  • Blogger arrested over Guns N’ Roses leak [The Age] – “A blogger suspected of streaming songs from the unreleased Guns N’ Roses album Chinese Democracy on his website was arrested and appeared in court, where his bail was set at $US10,000. FBI agents arrested 27-year-old Kevin Cogill on Wednesday morning on suspicion of violating federal copyright laws. Cogill appeared in court in the afternoon wearing a T-shirt; his girlfriend sat in court and afterward said, “Rally the troops”, but declined further comment. Federal authorities say Cogill posted nine unreleased Guns N’ Roses songs on his website in June. The songs were later removed.” (So, a hardcore fan shares some unreleased songs. Solution: send an email and ask him to remove then, he gets a kick from hearing from the band, and happily respects their wishes? Or try and get him locked up and fined?   • Age editor sacked after Fairfax cuts [ABC News (Australian Broadcasting Corporation)] – “The editor-in-chief of Melbourne’s Age Newspaper is the first casualty of Fairfax media’s job cuts. Andrew Jaspan, has been sacked as part of an overhaul by the newspaper’s owner, Fairfax. His abrupt departure comes a day after the media firm announced it was cutting 550 jobs in Australia and New Zealand. “
  • Woolies’ new card will trail shoppers [The Age] – “An unprecedented mountain of data will be amassed by the nation’s leading retail company with the launch of a sophisticated credit card that can follow shoppers on their spending trails and be used to entice them to buy more products. Woolworths’ Everyday Money Credit Card is the first in the country to combine a credit card with a sophisticated loyalty program capable of capturing and then sending a shopper’s purchasing details back to a central database. The database is linked to the company’s recently launched fuel voucher card.”

  • Monkey Magic – Karen Lury / University of Glasgow [Flow TV, 8.06] – Playful and engaging reading of the BBC Monkey-style BBC Opening for the Olympic Games: “A playful, irreverent choice then: a trailer that reverses a mythic journey (from West to East) and which pays overt homage to a cult TV series that was never – in any coherent sense – an ‘authentic’ reflection or interpretation of Chinese culture or mythology. … The animation itself reproduces certain static poses and a colour scheme that may have been inspired by Chinese illustration and Japanese Manga; but for Hewlett fans, this is recognisably a Hewlett world – a world that is both menacing and cute (and where ‘cute’ is revealingly close to its roots in the freakish world of the side-show). It is funny and slightly unsettling as Pigsy smirks provocatively or when Monkey opens his mouth to reveal his dirty and surprisingly sharp teeth.”
  • Tiger Woods Responds to Fan’s YouTube Video [Micro Persuasion] – “This video response is brilliant marketing on the part of Electronic Arts and Tiger Woods. A fan posted on YouTube that it’s possible for Woods to hit a golf ball in Tiger Woods 08 while walking on water. How does Tiger react? By showing how it’s done and promoting Tiger Woods 09 in the process. It shows they listen and bring in the big guns to engage.”
  • Digital futures report: the internet in Australia [CCI] – “This report provides an overview of our work, presenting results for each of the questions asked. We will also be publishing work that examines relationships between our key variables exploring, for example, differences between users with broadband access at home and those on dial-up connections and the differences that age, gender and education levels make to people’s use and experience of the internet. Analysis we have already conducted shows that broadband does make a substantial difference to peoples’ use of the internet. The internet is more highly valued by those with broadband connections and they use the internet for longer and for a greater variety of purposes.   • Few lives left for Second Life [The Age] – “Separately, figures released by the virtual world’s creator Linden Lab in April show there are only 12,245 active Australian Second Life users, down from highs of 16,000 towards the end of last year. … Australians appear to have lost interest in Second Life and the users still there appear to be shying away from the big corporate brands. Kim MacKenzie, a PhD student at the Queensland University of Technology, centred her honours year thesis around the business applications of Second Life. She studied the Second Life bases of 20 international brands over three months last year, including Dell, Toyota, Coca-Cola, BMW, AOL and Vodafone. “They were like ghost towns,” said MacKenzie, adding that many of the users she saw on the company islands appeared to be staff members.” (A significant rebuttal of the information and argument in this article can be found at Personalize Media.
  • For YouTube videos, a ‘fair use’ boost [News.com] – “Copyright owners, such as NBC Universal, Warner Bros., and Viacom, were put on notice Wednesday when U.S. District Judge Jeremy Fogel ruled that they must not order video be removed from Web sites indiscriminately. Before taking action against a clip, copyright owners, must form a “good-faith belief ” that a video is infringing, according to Corynne McSherry, an attorney with the Electronic Frontier Foundation. “
  • Poor earning virtual gaming gold [BBC NEWS | Technology] – “Nearly half a million people are employed in developing countries earning virtual goods in online games to sell to players, a study has found. Research by Manchester University shows that the practice, known as gold-farming, is growing rapidly. Researchers say the industry, which is largely based in China, currently employs about 400,000 young people who earn £80 per month on average.” (Good article, but really, “playbourers”?)
  • Up, Up, and Away? Separating Fact from Fiction in the Comic Book Business [Alisa Perren / Georgia State University – Flow TV 8.06] – A timely look at the relationship between comic book sales and the blockbuster movies they’ve been driving so successfully this year: “Myth #1: Comic-Con is all about comics. From its inception in 1970 well into the 1990s, this was largely the case. However, in recent years, the Hollywood studios increasingly have focused their energies on using the annual event as a means of promoting upcoming films and television programs. … Myth #2: Since movies based on comics are all the rage, comic books must be selling like crazy.”
  • iTunes blocked in China after protest stunt [WA Today] – “Access to Apple’s online iTunes Store has been blocked in China after it emerged that Olympic athletes have been downloading and possibly listening to a pro-Tibetan music album in a subtle act of protest against China’s rule over the province. The album, called Songs for Tibet, was produced by an a group called The Art of Peace Foundation, and features 20 tracks from well-known singers and songwriters including Sting, Moby, Suzanne Vega and Alanis Morissette. It was released as a download on the iTunes Store on August 5 – three days before the start of the Olympics – with the physical CD launched on Tuesday this week. The Foundation provided free downloads of the album to Olympic athletes, urging them to play the songs on their iPods during the Games as a show of support.”

  • Ancient Free Gardeners – flying the CC banner [Creative Commons Australia] – “… Ancient Free Gardeners, a Melbourne-based indie band who use CC licences to distribute their music. We’re very pleased to announce that AFG have released their new single, Innards Out, under a CC BY-NC-SA licence, which allows it to be freely distributed and even remixed. And they’re getting quite a bit of attention from it.”
  • Internet becomes Iraq’s new matchmaker [The Age] – “Young Iraqis in Baghdad are surfing the internet to search for partners to tie the knot as violence and sectarian tensions take their toll on more traditional forms of socialising. Dating has fallen victim to the insecurity that has reduced the capital to a sullen network of rival neighbourhoods, leaving little space for men and women to meet other than in cyber chat rooms. “I think the Iraqis are looking for love on the internet because there are no other places for them to meet,” said Mustafa Kazem, a 20-year-old engineering student who found his soulmate on a university chat forum.”
  • Brands line up for Bond sequel [Variety] – “James Bond is bringing back some familiar brands in “Quantum of Solace.” Sequel to “Casino Royale” will again be backed by Ford Motor Co., Heineken beer, Smirnoff vodka, Omega watches, Virgin Atlantic, Sony Ericsson cell phones and other Sony electronics. These brands all have products placed in the film and each will shell out tens of millions of dollars as a promotional partner of the pic. Sony Pictures, which is distribbing the movie, declined to disclose how much the brands are ponying up, but returning partners spent up to $100 million worldwide on ad efforts around “Casino Royale,” industryites estimate.   • Italy blocks The Pirate Bay [The Age] – “An Italian judge has ordered the country’s internet service providers to block access to The Pirate Bay, a Swedish file-sharing website, as part of a probe into copyright law violation, officials said on Thursday. Since last week, Italy’s anti-fraud police have been informing providers they must heed the order of a judge in the northern city of Bergamo, police Col. Alessandro Nencini said.” (Apparently the impact of this ‘ban’ has been to increase Italian traffic to The Pirate Bay!

Girl Talk Flouts Copyright Law [NYTimes.com] – “Girl Talk, whose real name is Gregg Gillis, makes danceable musical collages out of short clips from other people’s songs; there are more than 300 samples on “Feed the Animals,” the album he released online at illegalart.net in June. He doesn’t get the permission of the composers to use these samples, as United States copyright law mostly requires, because he maintains that the brief snippets he works with are covered by copyright law’s “fair use” principle …Girl Talk’s rising profile has put him at the forefront of a group of musicians who are challenging the traditional restrictions of copyright law along with the usual role of samples in pop music.” Girl Talk’s latest album Feed the Animals can be downloaded for whatever price users choose to pay (including choosing to pay nothing).
  • MisUnderstanding YouTube by Joshua Green [Flow TV 8.05] – “… popularity on [YouTube] revolves as much around what is “Most Discussed” or “Most Responded” as it does what is “Most Viewed.” … Understanding this is crucial to effectively accounting for YouTube as a diverse media space.   • Human rights group broadcast ‘pirate’ radio show in Beijing [Radio Australia] – “A human rights group has broken China’s tight control of the media by broadcasting a radio show calling for freedom of expression in Beijing.   • It’s public so what’s the privacy issue with Google’s Street View? [The Courier-Mail] – Peter Black tells it like it (legally) is regarding Google Streetview in Australia: “What Google did was perfectly legal. They took photographs of houses, buildings and streets from a public place. If anyone can legally walk up and down your street taking photographs of houses, why can’t Google? They can. Once this is accepted, the argument then becomes one about people randomly caught in the lens of the camera. “Surely they don’t have a right to take a photo of me?” Yes they do. You can have no reasonable expectation of privacy, let alone a right to privacy, when you are in a public area, such as your street.”
